Appointment of Digital Administrator within Will
I nominate John J. Representative as my digital administrator. If John J. Representative is unable or unwilling to act as my digital administrator, I nominate Susie Q. Representative as my digital administrator. If both John J. Representative and Susie Q. Representative are unable or unwilling to act as my digital administrator, my then acting Personal Representative shall have the limited authority to access my primary personal email account only and is instructed to notify all other Internet service providers of my death and that such accounts registered through these service providers shall be terminated. No other persons shall have the right to access my digital assets.
My digital administrator shall have the right to access all of my digital electronic mail, social networking and blogging accounts according to the instructions I have provided under a separate writing. The assets my digital administrator may access are set forth in a list attached to this Last Will and Testament.
If my digital administrator is not also serving as my personal representative, he or she shall have no other authority to act as the fiduciary of my estate. Likewise, my personal representative shall have no personal or fiduciary liability for the actions or inactions of any other person acting as my digital administrator, including any damages my estate may suffer as a result of this appointment.
I intend that this appointment shall be considered a testamentary appointment pursuant to section 3-617 of the Uniform Probate Code and I expressly release any service providers, as that term is defined in 17 U.S.C.S. §512(k)(1)(A), from any potential liability under the Stored Communications Act, 18 U.S.C.S. §2702(b) and (c).
